1. Payment Terms

   • Payment Methods: We accept Visa, MasterCard, American Express, and Discover for purchases below $10,000 USD. For orders of $10,000 USD or more, please contact our sales team to arrange suitable payment methods.
   • Payment Schedule: Payments are due upon order placement unless prior arrangements have been made.
   • Late Payments: Invoices not paid within the agreed terms will incur interest at a rate of 2% per month (24% annually).

2. Order Policies

   • Minimum Order Requirements: Wholesale customers are required to meet a minimum order value of $100 per purchase.
   • Order Acceptance: All orders are subject to acceptance by Performance Diesel, Inc. We reserve the right to refuse any order based on account status or product availability.

3. Shipping and Delivery

   • Shipping Methods: Orders are shipped via standard ground service unless otherwise specified. Expedited shipping is available upon request and may incur additional charges.
   • Shipping Charges: Shipping costs are calculated based on order size, weight, and destination, and will be added to the invoice.
   • Delivery Times: Estimated delivery times are provided at the time of order and are subject to change based on carrier availability and other factors beyond our control.

4. Returns and Exchanges

   • Return Policy: Returns are accepted within 30 days from the date of purchase, provided the items are in new, unused condition and in original packaging. A restocking fee of 15% may apply.
   • Non-Returnable Items: All electronic sales are final and non-returnable.
   • Return Process: To initiate a return, contact our customer service department for a Return Merchandise Authorization (RMA) number. Unauthorized returns will not be accepted.

5. Core Returns

   • Core Return Policy: Credit for core returns will be issued if the core is returned within 45 days of the original purchase date. Cores must be in rebuildable condition to qualify for credit.

6. Warranty

   • Product Warranty: Performance Diesel, Inc. warrants all products against defects in materials and workmanship for a period of 90 days from the date of purchase.
   • Exclusions: This warranty does not cover damage caused by misuse, improper installation, or modifications. 

7. Limitation of Liability

   • Indirect Damages: Performance Diesel, Inc. is not liable for any indirect, incidental, or consequential damages arising from the use of our products.
   • Delays: We are not responsible for losses caused by unavailability of parts or delays in delivery beyond our control.

8. Governing Law

   • These terms and conditions are governed by and construed in accordance with the laws of the State of Utah.

9. Changes to Terms

   • Performance Diesel, Inc. reserves the right to modify these terms and conditions at any time. Changes will be effective upon posting to our website.

SMS Terms & Conditions

SMS Consent Communication:
The information (Phone Numbers) obtained as part of the SMS consent process will not be shared with third parties for marketing purposes.

Types of SMS Communications:
If you have consented to receive text messages from Performance Diesel Inc., you may receive messages related to the following:

• Customer Service
• Promotions or offers (if applicable)

Message Frequency:
Message frequency may vary depending on the type of communication. For example, you may receive up to [X] SMS messages per week related to your [appointments/billing, etc.].

Please note that standard message and data rates may apply, depending on your carrier’s pricing plan. These fees may vary if the message is sent domestically or internationally.

You can opt out of receiving SMS messages at any time. To do so, simply reply "STOP" to any SMS message you receive. Alternatively, you can contact us directly to request removal from our messaging list.
